Nether Athletic – Terms & Conditions

These terms and conditions govern how we supply our products to you. By purchasing from us, you agree to these terms, so please read them carefully. We may update these terms from time to time by posting a revised version on netherathletic.com. The version active at the time of your order applies.

2. Placing an Order

2.1 Orders are placed through our website. Please confirm your size, items, and shipping address carefully before completing the order.

2.2 You will receive an order confirmation email. A contract is formed once your order is dispatched and we send a shipping confirmation.

2.3 You must be at least 18 years old or have parental consent. You must be authorized to use the payment method provided.

3. Our Right to Cancel Your Order

3.1 If we cannot fulfill your order (e.g., item out of stock or clear pricing error), we will notify you and issue a refund.

3.2 We may cancel orders that appear to be placed for resale or commercial activity.

3.3 We may pause supply to resolve technical or legal requirements.

4. Our Products

4.1 We offer athletic apparel and accessories.

4.2 Product photos are for illustration purposes only. Colors may vary slightly due to screen settings or lighting.

5. Delivery

5.1 We ship internationally.

5.2 Risk of loss transfers to you once the order is handed to the shipping carrier.

5.3 Shipping fees and estimated delivery times appear at checkout.

5.4 We are not responsible for courier delays, customs inspections, or other factors outside our control.

5.5 If no one is available for delivery, the courier will provide instructions for redelivery or pickup.

6. Your Rights

6.1 If you receive an incorrect, damaged, or defective product, you are entitled to a replacement or refund.
Contact us within 14 days of delivery with your order number and clear photos/videos.

6.2 Aside from receiving an incorrect or faulty item, orders cannot be cancelled or refunded due to our final-sale policy.

7. Returns & Refunds (Final Sale Policy)

Because our products are limited stock and handled individually, All sales are final.

7.1 Final Sale

We do not accept returns, cancellations, exchanges, or refunds for:

  • Change of mind

  • Ordering the wrong size

  • Delivery delays outside our control

  • Preference-based reasons

Please carefully review size charts and product details before purchasing.

7.2 Exceptions (We WILL replace or refund if these apply)

You are eligible for a replacement or refund only if:

  • You received the wrong item, wrong size, or wrong color, or

  • The item arrived damaged or faulty

To begin a claim:

  1. Email support@netherathletic.com within 7 days

  2. Include order number + clear photos/videos

If confirmed, we will:

  • Send a replacement for free, OR

  • Issue a full refund if a replacement is unavailable

7.3 Non-Returnable Items

  • Correctly delivered items

  • Items not in original packaging

  • Hygiene-sensitive items

  • Custom/personalized items

  • Final sale products (all our products are final sale unless stated otherwise)

8. Our Right to End the Contract

We may cancel your order if:

  • You provide incomplete or incorrect delivery information

  • Delivery is refused or repeatedly unsuccessful

Refunds apply only to undelivered items.

9. Pricing & Payment

9.1 Prices may appear in your local currency. Taxes and shipping are shown at checkout.

9.2 Prices may change at any time. The price at order time is final.

9.3 If a clear pricing error occurs, we may cancel the order and issue a refund.

9.4 We accept Visa, Mastercard, Amex, Apple Pay, and PayPal. You are charged once your order is dispatched.

10. Discount Codes

Discount codes:

  • Are valid during their stated promotion

  • Cannot be used on sale items unless specified

  • Are not transferable or redeemable for cash

  • One discount code per order

  • Refunds (for eligible cases) reflect the discounted price paid

11. Limitation of Liability

11.1 We are not responsible for losses beyond our reasonable control.

11.2 Our liability is limited to the amount you paid for the product.

11.3 We do not limit liability where illegal to do so (e.g., fraud, injury).

11.4 We are not liable for business-related losses such as missed profits or opportunities.

12. Privacy

We use your personal information in accordance with our Privacy Policy.

13. General Terms

13.1 We may transfer our rights to another entity.
13.2 You may not transfer your rights without our permission.
13.3 If any part of these terms is found unlawful, the rest remain valid.
